NiseBookings terms and conditions

Draft, not yet legally reviewed. Version: draft 2026-11-05. This is a translation of the Dutch text. If the two differ, the Dutch text applies.

1. Definitions

  • Nise: Regentesselaan 142, 2562 EE Den Haag, the Netherlands, info@nisebookings.com.
  • Service: NiseBookings, the online booking software with its admin, widget, APIs and mails.
  • Customer: the business, organisation or self-employed person holding an account.
  • Project: a separate booking environment within the Service, also called a client account.
  • End customer: someone who books with the Customer through the Service.

2. Scope

  1. These terms apply to all use of the Service, including Free.
  2. The Service is only meant for use in the course of a profession or business. By creating an account the Customer declares that this is the case.
  3. Deviations only apply if the parties agree them in writing. The Customer’s own terms do not apply.
  4. The processor agreement is part of these terms. If they conflict on personal data, the processor agreement prevails.

3. Account

  1. The agreement starts once the Customer has created the account and accepted these terms.
  2. The Customer keeps login details and API keys secret and is responsible for what happens through the account.
  3. The Customer decides who gets access and with which role.

4. Subscriptions

  1. There are three plans: Free, Pro and Agency. Content, limits and prices are those on the pricing page at the time of subscribing.
  2. Agency includes five Projects. Each extra Project costs the amount on the pricing page.
  3. Above a plan’s limit the Service may refuse new bookings or other actions.

5. Term and cancellation

  1. A monthly subscription runs for 1 month and a yearly subscription for 1 year. If the Customer pays for the next period, the subscription continues for that period.
  2. The Customer can cancel at any time, effective at the end of the current period.
  3. Amounts paid are not refunded, including for any unused part of the period.
  4. After a paid period ends the Project falls back to Free. Free features and limits then apply.
  5. The Customer can end a Free account at any time by mailing Nise. Until this can be done in the Service itself, ending an account goes through info@nisebookings.com.
  6. Nise may end the agreement with 1 month’s notice. For a serious breach of these terms it may do so immediately.

6. Payment

  1. Nise currently invoices by hand: the Customer requests a plan by mail and pays in advance through a payment link.
  2. Payment may later run automatically through Mollie. The Customer then chooses a plan in the Service. Manual subscriptions stay in force until the Customer switches.
  3. All amounts are due in advance.
  4. Nise may change prices. New prices apply from the next period, and the Customer gets at least 30 days’ notice.

7. Late payment

  1. If the paid period ends without payment, the Customer is notified and the Service keeps working fully for 14 more days.
  2. If payment has not arrived after those 14 days, the Project becomes read-only. New bookings are refused; existing data stays visible.
  3. After payment the Project works normally again at once.
  4. Existing appointments during read-only remain the Customer’s responsibility, also towards End customers.

8. Transferring a Project

  1. An agency can transfer a Project to its client. It makes that client the owner in the Service and then removes its own access.
  2. From the transfer on, the new owner is the Customer for that Project and must accept these terms and the processor agreement itself.
  3. After transfer the Project falls back to Free, unless the new owner takes a plan of their own. The agency’s subscription does not move with it.
  4. The agency arranges with its client beforehand that there is a basis for transferring the data.

9. Use

  1. The Customer uses the Service in line with the law and may not use it to harm the Service or others.
  2. The Customer is responsible for what it puts in the Service, for its own website, and for its own terms and privacy statement towards End customers.
  3. The Customer does not ask for special categories of personal data in free fields and uploads unless it has a basis to do so.
  4. Online payments by End customers run through the Customer’s own Mollie account. That is an agreement between the Customer and Mollie. Nise is not a party to it.
  5. Nise may block access when needed to stop abuse or damage.

10. Availability and support

  1. Nise does its best to keep the Service available, but gives no availability guarantee. There is no SLA.
  2. Nise may change the Service and carry out maintenance, even if the Service is temporarily unavailable as a result.
  3. Support runs through info@nisebookings.com, without a fixed response time.
  4. The Service is provided as is. Nise does not guarantee that it is free of errors or fit for a particular purpose.

11. Rights

All rights in the Service stay with Nise. The Customer gets a non-exclusive, non-transferable right of use for as long as the agreement runs. The data the Customer enters remains the Customer’s.

12. Liability

  1. Nise’s liability, per event and for all events together in a calendar year, is limited to what the Customer paid for the Service in the 3 months before the damage, and never exceeds € 500.
  2. On Free, Nise pays no damages.
  3. Nise is not liable for indirect damage, such as lost revenue, missed bookings, reputational damage and fines.
  4. These limits do not apply if the damage results from intent or deliberate recklessness on Nise’s part.
  5. Damage must be reported in writing within 3 months of discovery.
  6. Failure to perform through force majeure gives no right to damages. This includes outages at suppliers.

13. End of the agreement and data

  1. After an account has ended, Nise keeps the data for 1 more year and then deletes it, unless the Customer explicitly asks for earlier deletion.
  2. Falling back to Free does not end the account.
  3. There is no export button. The Customer can retrieve data until the end through the admin and, if its plan includes it, through the management API.
  4. Provisions that by nature continue stay in force, such as confidentiality and liability.

14. Changes to these terms

Nise may change these terms. The Customer gets at least 30 days’ notice and is asked to accept the new version on signing in. If the Customer does not accept, it can cancel at the end of the current period.

15. Governing law and disputes

This agreement is governed by Dutch law. Disputes go to the District Court of The Hague.
